Terms of Service

1. Acceptance of Terms

By accessing or using the LUNA AI Art Generator mobile application and the website at https://www.aiartmaker.app (collectively, the "Service"), operated by Rocket Digital Limited, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

LUNA AI Art Generator is an AI-powered image generation application that allows users to create images from text prompts, transform photos using AI styles, generate AI portraits, and explore various artistic styles. The Service is available on iOS and Android platforms.

3. User Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information and notify us immediately of any unauthorized use.

4. Intellectual Property

4.1 User-Generated Content

You retain ownership of the AI-generated images you create using LUNA. For free users, images are licensed for personal, non-commercial use. LUNA Pro subscribers receive full commercial usage rights for all generated content.

4.2 Service Content

All intellectual property rights in the Service, including but not limited to the app design, logo, AI models, algorithms, and software, are owned by Rocket Digital Limited or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

5. Prohibited Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Create deepfakes or non-consensual intimate imagery of real people
  • Generate content that infringes on intellectual property rights
  • Create content depicting child exploitation or abuse
  • Attempt to bypass content filters or safety mechanisms
  • Use the Service for any fraudulent or deceptive purpose
  • Overload, disrupt, or interfere with the Service infrastructure
  • Resell, redistribute, or sublicense access to the Service

6. Third-Party Services

The Service integrates with the following third-party services, each subject to their own terms and conditions:

  • RevenueCat — Subscription and in-app purchase management
  • Firebase (Google) — Authentication, cloud storage, and analytics
  • Google AdMob — Advertising services
  • OpenAI — AI image generation
  • Microsoft Azure — Cloud computing and processing
  • Replicate — AI model hosting and inference
  • Fal.ai — AI model inference
  • Google Analytics — Website analytics
  • Meta Pixel — Conversion tracking

We are not responsible for the practices or policies of these third-party services.

7. Subscriptions and Payments

LUNA offers free and premium subscription plans. Subscriptions are managed through the Apple App Store and Google Play Store, with payment processing handled by RevenueCat.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions through your device's app store settings
  • Refunds are handled by the respective app store according to their refund policies
  • Prices may vary by region and are subject to change with notice

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • AI-generated content will meet your specific requirements or expectations
  • The results of AI generation will be accurate, reliable, or suitable for any particular purpose

9. Limitation of Liability

To the maximum extent permitted by applicable law, Rocket Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections relating to intellectual property, disclaimers, and limitation of liability will survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitute acceptance of the modified Terms.
